James Michael Dunphy, Jr. is an Of Counsel attorney in the Firm’s Boston, MA office.  During the last 14 plus years, he has litigated matters in the areas of premises liability, dram shop liability, railroad claims under the Federal Employers’ Liability Act (FELA), railroads, product liability, motor vehicle liability, construction liability and civil rights violations.  He has also actively defended and successfully tried insurance fraud cases.

Mr. Dunphy has tried numerous cases involving premises liability and motor vehicle liability.  He has tried, litigated, arbitrated and advised premises liability cases on behalf of national corporate clients. Mr. Dunphy has defended product liability cases for a variety of manufacturers and retailers, including the following types of products: elevators, electrical utility equipment, propane cylinders, liquid stripper, lighting fixtures, landscaping equipment, furniture and retail merchandising products.  A significant portion of Mr. Dunphy’s practice entails alternative dispute resolution; including binding arbitration and mediation.  During a typical year, he defends 10 to 15 binding arbitrations. 

Throughout his career, Mr. Dunphy has utilized dispositive motions as a means of resolving cases for clients.  He has obtained more than 25 victories, as a result of dispositive pleadings (Motions to Dismiss, Summary Judgment Motions and Mass. R. Civ. P. 33(a) Applications) for retail stores, taverns, corporate clients and individuals.

Mr. Dunphy is admitted to practice law in the state and federal courts of Massachusetts and Vermont.  He is a member of DRI and the Vermont Bar Association.

James Michael Dunphy, Jr. graduated cum laude from Villanova University, in 1990, and he received his J.D. from New England School of Law, in 1994.
