|Third Circuit Upholds Favorable Verdict by Mark Lockett|
In September 2014, Bonner Kiernan attorney Mark Lockett received a favorable verdict after a seven day trial in the United States District Court for the Eastern District of Pennsylvania. Plaintiff fell over a flatbed hand truck while walking through the checkout aisle of a national retail store. The incident was captured on videotape surveillance. Plaintiff alleged lumbar/cervical disc herniations, carpel tunnel syndrome, regional pain syndrome and depression as a result of the fall. She claimed that she was permanently injured and incurred $2.5 million in economic loss. The jury returned a verdict of $5,000 reduced 50% of plaintiff’s comparative negligence. In an Opinion dated March 15, 2016, the Third Circuit Court of Appeals affirmed the jury's verdict and ruled that it had a reasonable basis to find that plaintiff did not suffer any compensable pain and suffering and that the District Court did not abuse its discretion in denying a new trial.
