|Mark Lockett and Ava Plakins Obtain Summary Judgment by Pennsylvania Federal Court|
A federal judge in the Middle District of Pennsylvania granted Bonner Kiernan’s Motion for Summary Judgment filed on behalf of a national retail store that operated a large distribution center in Northeastern Pennsylvania. Plaintiff, an independent truck driver, claims she injured her back causing a permanent disability when she slipped and fell on ice while attempting to unhitch the tractor from the trailer at the loading dock. The court ruled that any duty of care owed to plaintiff was obviated as a matter of law because she voluntarily encountered an open and obvious condition.
The plaintiff did not appeal the trial court’s ruling.
